Shocking testimony: Palestinian children traumatized in Israeli jail

A Palestinian academic sounded the alarm over the preplanned tactics of psycho-physical torture perpetrated against Palestinian children in Israeli jails.

Director of the research unit at the Treatment and Rehabilitation Center for Victims of Torture (TRC) referred to the dubious nature of a decision by the Israeli High Court to cease all forms of physical torture against the detainees.

However, the court rule legitimized the torture of those who fell under the “ticking bomb” blacklist, a category from which no Palestinian detainee seems to have been safe.

According to Sahwil, Israel categorizes as “ticking bombs” those who hold pieces of information that “might affect Israelis’ lives.”

The academic dubbed such a two-faced court rule “a cover to legitimize torture and grant Israeli investigators more protection and immunity.”

In Sahwil’s terms, facts on the ground prove that Tel Aviv is violating its obligations as a signatory of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment.

The researcher said torture in Israeli jails often proceeds along the following four lines, respectively: Psycho-physical torment, internment in isolated cells, criminalization by calling the child a terrorist and a criminal until he/she internalizes that indignation and reaches a stage of self-loathing. The last stage revolves around a process of indoctrination and brainwashing to force the child to spy for Israel.

“Torture in Israeli jails does not just aim to force confession; it also seeks to dampen the children’s spirits and to paralyze them both intellectually and socially,” warned Sahwil. “Such policies aim to give birth to a generation of traumatized youth.”

Referring to the psychoanalytic studies, Sahwil said a child who had been subjected to torture and violence in his/her early childhood is also at high risk of internalizing violence and thus “behaving violently towards their family and society.”

He further spoke out against the psychotic disorders wrought by torture, most notably insomnia, nightmares, tachycardia, and voluntary solitude.

Ramallah-based TRC kept record of the arrest of 2,000 Palestinian children in 2016, up from 600 in 2015.

The center further documented cases of “immoral” violations and aggressions by the Israeli occupation soldiers against the Palestinian minors while being handcuffed and blindfolded.

“The most dangerous of such felonies are rape threats and molestation simulation. At a certain point, Israeli investigators start to take off their clothes and force the child to do the same until he/she is psychologically broken down,” said Sahwil.

“Even girls below the age of puberty are not safe from such torture tactics . . . at an age where they quite normally need psychological support,” he further stated.

The researcher called for an urgent action to save Palestinian children in Israeli jails, heal traumatized minors, and force Israel to cease all forms of mistreatment against Palestinian children.

The Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment adopted and opened for signature, ratification and accession by General Assembly resolution 39/46 of 10 December 1984 and which entered into force on 26 June 1987 defined torture as: “any act by which severe pain or suffering, whether physical or mental, is intentionally inflicted on a person for such purposes as obtaining from him or a third person information or a confession, punishing him for an act he or a third person has committed or is suspected of having committed, or intimidating or coercing him or a third person, or for any reason based on discrimination of any kind.”

Article 2 of the convention also stipulated that: “No exceptional circumstances whatsoever, whether a state of war or a threat of war, internal political instability or any other public emergency, may be invoked as a justification of torture.”

Report: “10 Detainees Died In Israeli Prisons Since 2010, 210 Since 1967”

The Palestinian Detainees’ Committee have reported, Saturday, that ten detainees have died in Israeli prisons since the year 2010, and that the total number of detainees who died in prison, due to various reasons, including torture and medical neglect, since the year 1967 has arrived to 210.

The Committee stated that the latest casualty was detainee Mohammad Amer al-Jallad, 24, from Tulkarem in the northern part of the occupied West Bank, who died on February 10th, 2017, at an Israeli hospital.

Israeli soldiers shot and seriously injured him, on November 9, 2016, after claiming that he attempted to stab them at the roadblock, and was moved to the Intensive Care Unit at Beilinson Israeli hospital, suffering gunshot wounds to the chest, but remained in a critical condition until his death.

The Detainees’ Committee stated that 58 Palestinian detainees have died due to medical neglect by the Israeli Prison Authority, and most of them were only moved to hospitals after their health conditions became terminal.

It added that 71 Palestinian detainees died while being tortured during interrogation, 7 died after being beaten or shot while in prison, and 74 were executed by the arresting officers, under various allegations.

There are also hundreds of freed detainees who died shortly after their release, as they suffered various serious illnesses while in prison, and never received the adequate and specialized medical attention.

One of them is Na’im Shawamra, from Doura town, in the southern West Bank district of Hebron who died on August 06, 2016.

The Committee sated that Israel’s prisons, detention and interrogation centers became places “where death and its seeds are planted in the detainees’ bodies,” and added that 10 Palestinian detainees have died in Israeli prisons since the year 2010.

“This is a very serious issue; what is happening is a war crime, a premeditated crime against humanity” the Committee stated in its report.

The detainees who died since 2010 have been identified as Raed Abu Hammad, Mohammad Abdul-Salam Mousa, Arafat Jaradat, Maisara Abu Hamdiya, Hasan Torabi, Raed al-Ja’bari, Fadi Darbi, Yasser Hamdouna, As’ad al-Wali and Mohammad al-Jallad.

MADA Report: 383 Media Freedoms Violations during 2016

The Palestinian Center for Development and Media Freedoms, “MADA”, organized a press conference on Wednesday 02/08/2017, and released its annual report of violations against media freedoms in Palestine during 2016, according to the PNN.

Mr.  Mousa Rimawi- General Director of MADA center and Dr. Ammar Dweik- General Direct of The Independent Commission for Human Rights kicked off the conference with an opening speech.

Rimawi said that 2016 witnessed a significant decrease in the total number of violations monitored against media freedoms in Palestine, compared to 2015.  MADA monitored a total of 383 violations during 2016, in Palestine.

He added that Israeli occupation forces committed a total of 249 violations — approximately 65% — whereas, Palestinian parties in the occupied West Bank and Gaza Strip committed a total of 134 violations — roughly 35% of all violations recorded in 2016.

The main reason behind the decline in Israeli violations backs to the fact that, during 2016, Palestinian occupied territories did not witness eruptions of mass confrontations between Palestinians and Israelis.

The major cause of the decline in Palestinian violations was mainly due to a relatively stable situation, as no internal events erupted, no repercussions for the internal political division were monitored, which was and still is considered as one of the most prominent causes of the violations targeting media freedoms in West Bank and Gaza.

The murder of a media student at Al-Quds University, Omar Sajdieh (22 years), by Israeli forces, besides the injury and detention of dozens of Palestinian journalists, raids, seizures and sabotage of media outlets, including the shutdown of 12 Palestinian media outlets and printing houses. are all considered as the gravest and most prominent violations recorded in 2016.

He said that Israeli violations against media freedoms are generally featured in a context of 18 different types, but that the bulk revolved around 7 particular types which include physical assaults and detentions, prevention of press coverage, closure of media institutions, seizure/ sabotage of equipment, and detention of journalists. However,  the most serious violations constitute around 84% (208 violations) of Israeli violation, in total (249 violations), during 2016.

He added that “last year witnessed attempts of Palestinian security apparatuses, in [the] West Bank and Gaza Strip, practicing certain types of torture against Palestinian journalists during their detention and interrogation, besides the continuation of prosecuting journalists in relation to their publications of social media sites.”

He also noted that ”2016 witnessed a total of 86 Palestinian violations in West Bank against media freedoms, which fell under 14 types, the majority were three types (summon and interrogation/ arrest and detention/ prevention of coverage).

Whereas a total of 48 violations against media freedoms were monitored in Gaza Strip, most of them fell under 9 types, and the majority of violations revolved around two major types (summon and interrogation/ detention and arrest). Noting that the political internal division that occurred since 2007 is still considered as the major reason for such violations.

Clarifying that such differences does not implicate that media freedoms’ status in Gaza Strip are better than in West Bank, but it is due to numbers of journalists and media outlets are less in Gaza.

Dr. Ammar Dweik assured the importance of MADA’s efforts in defending media freedoms, particularly monitoring and documenting violations against freedom of expression and opinion, highlighting the importance of the collective cooperation of all Palestinian Civil society organizations to expose all Israeli violations, and hold perpetrators accountable, of all systematic assaults against Palestinian journalists. All through a cumulative work that ensures the presence of a well-developed legal environment which guarantees media freedoms in Palestine.

Dr. Dweik also disclosed that the Independent commission for human rights demanded the attorney general stop all procedures against the writer Abbad Yahia, author of the novel entitled “Crime in Ramallah,” and to transfer the case to the Ministry of Culture, to solve.

He also assured that summoning the author and prosecuting him, and the withdrawal of the novel, constitutes an infringement of the Palestinian modern image, and its progress and the protection of creativity and creators. It is of particular note that Palestine ratified several international treaties which assure the respect of freedom of opinion and expression in all aspects.

He also explained that the commission considered criminal proceedings against the Palestinian novelist as a precedent in Palestine, since the establishment of the Palestinian Authority. Besides the fact that such procedures may open the way to legitimize incitement and personal attacks against the author on social networks, which could pose a threat to his personal safety.

MADA, in its report, welcomed the decline of violations against media freedoms in Palestine during the last year. MADA also expressed its concern over the continued and regular violations, recommending the following:
MADA urges…

The international community to compel Israel to respect freedom of expression that is guaranteed in the International Covenant on Civil and Political Rights.
An immediate stop of Israeli pressure on social media companies, including Facebook and Twitter, to posing restrictions on freedom of expression.
Immediate release of all Palestinian journalists and to stop administrative detention.

Stop the policy of shutting down media institutions and compensate all institutions that were shut down, or had their equipment confiscated or destroyed.
Hold aggressors of journalists accountable.

On the Palestinian side:

Palestinian security forces (West Bank/ Gaza Strip) should comply with the Palestinian Basic law in terms of respecting freedom of expression.
Amend articles and clauses that are related to “publication crimes” in the Jordanian penal code 1960, which applies in the West Bank, and certain amendments on publication and printing law (1995).

Enacting modern Palestinian laws which are in line with international standards, linked to media freedoms/ freedom of expression and, particularly, access information law as a fundamental step towards democracy.

Protection of human rights, in general, and rule of law to serve as a deterrent in case of future violations, especially as Palestine did in fact ratify several international treaties including the International covenant on civil and political rights without reservation.

Hold aggressors of journalists accountable.
