The Palestinian Authority court in Tulkarem afternoon Thursday cleared
four Hamas-affiliated young men of charges about their intention to form
an armed militia, after five years of court hearings.
The acquitted Palestinians told the Palestinian Information Center (PIC) that The Tulkarem court decided to clear us of all charges filed by the preventive security apparatus after five years of adjournment.
"45 hearings had been held over the past five years to reach a decision on the lawsuit, and that disrupted our study and jobs," they said.
The released young men are journalist Yazid Khedr, Alaa al-Araj, Tarek Redwan, and Mohamed Salim.

PCHR Calls for Immediate Moratorium on the Use of the Death Penalty as a Form of Punishment in the occupied Palestinian territories.
The Palestinian Center for Human Rights (PCHR) renews its demand for the abolishment of the death penalty in the occupied Palestinian territories (oPt) as Gaza courts issued a second death sentence in 2015.
On Monday, 19 January 2015, the Court of First Instance in Gaza City, acting as a court of appeal, sentenced E. M. A. (24), from al-Maghazi refugee camp in the Central Gaza Strip, to death by hanging after convicting him of shooting and killing M. B. A. (68), from al-Maghazi refugee camp in a family dispute on 15 February 2009.
A first degree court had sentenced the aforementioned to life imprisonment on 9 March 2014, but the Prosecutor appealed the ruling, and the sentence was raised by the Court of Appeal to death.
It should be noted that the defendant was 18 when the first sentence was issued.
This sentence has been the second of its kind in the occupied Palestinian territory (oPt) since the beginning of 2015 where the first death sentence was issued by a military court in Hebron against (A. L. A.) on 11 January 2015 after convicting him of collaboration with the Israeli forces.
Thus, the total number of death sentences issued by the Palestinian Authority since 1994 has risen to 157, of which 130 have been issued in the Gaza Strip and 27 in the West Bank.
Among those issued in the Gaza Strip, 72 have been issued since Hamas took over the Gaza Strip in 2007.
The Palestinian Authority also executed 32 death sentences, of which 30 have been executed in the Gaza Strip and 2 in the West Bank.
Among those executed in the Gaza Strip, 19 have been executed since 2007 without ratification by the Palestinian President in violation of the law.
PCHR is gravely concerned over the continued application of the death penalty in Palestinian Authority controlled areas, and:
1. Calls for an immediate moratorium on the use of the death penalty as a form of punishment because it violates international human rights standards and instruments, especially the Universal Declaration of Human Rights (1948), the International Covenant on Civil and Political Rights (1966), and the UN Convention against Torture (1984);
2. Calls for reviewing all legislation related to the death penalty, especially the Penal Law No. 74 (1936) which remains in effect in the Gaza Strip, and the Jordanian Penal Code No. 16 (1960) that is in effect in the West Bank, and enacting a unified penal code that is in line with the spirit of international human rights instruments, especially those pertaining to the abolition of the death penalty;
3. Points out that the call for abolition of the death penalty does not reflect a tolerance for those convicted of serious crimes, but rather a call for utilizing deterrent penalties that maintain our humanity; and
4. Stresses that ratification of the implementation of death sentences is an absolute power of the Palestinian President according to the Palestinian Basic Law and relevant laws, and no death sentence can be implemented without such ratification.

The Palestinian Commission Of Detainees in Gaza City has reported that unknown assailants burned its main office, before dawn on Tuesday, and that some of its computers were stolen.
The Commission said the main door of the office was smashed, and it appears the fire was deliberately set, after the assailants had stolen some computers.
A representative of the Commission added that the attack targets all Palestinian political prisoners who are held by Israel, as the attackers are (consciously or unconsciously) serving the interest of the Israeli occupation in disenfranchising the population of Gaza.
The Commission demanded that the Palestinian Police and security forces in Gaza investigate the attack and apprehend the assailants.
Abdul-Nasser Ferwana, head of the Census Department of the Commission in Gaza told IMEMC, “We never discriminated against anybody; we are here to serve the detainees; the attack only serves the interests of the Israeli occupation,” he said, “We are calling on the security forces and police to investigate the attack, its motives, and bring the assailants to justice.”

MPs affiliated with the Change and Reform Bloc strongly condemned on Monday the kidnap of two ex-detainees at the hands of members of Fatah movement.
The Islamic bloc described the kidnapping of the ex-detainee Najeh Issa and the kidnapping attempt of Nader Sawafta as “a serious escalation that threatens the Palestinian national unity.”
The bloc held the Palestinian Authority (PA) fully responsible for the safety and protection of Palestinian citizens in the West Bank, calling for putting an end to the mischievous acts of its security forces and its affiliated armed persons.
The bloc called on PA Chairman Mahmoud Abbas to bear his responsibility in this matter and to hold those perpetrators accountable.
Change and Reform Bloc also stressed the need to stand firmly against such strange and unusual practices.

Hamas Movement stated in a press statement issued on Sunday that the “criminal” targeting of the Movement’s members and cadres in the West Bank along with PA and Israeli forces’ arrest campaign will not stop resistance.
Commenting on the ex-detainee Najeh Issa’s kidnapping at the hands of members of Fatah movement, Hamas said that kidnapping is a failed attempt to stop the popular revolt in occupied West Bank and Jerusalem.
The perpetrators aim at targeting the unity of the Palestinian people under flimsy pretexts that only serve the occupation, the statement added.

In al-Khalil, two ex-detainees were arrested after being summoned for investigation. Both of the detainees were previously arrested in PA jails.
An ex-detainee was also summoned for investigation in al-Khalil a few days after being released from an Israeli prison.

The International Federation for Human Rights and Development said in a statement issued Wednesday that “PA forces escalated over the past two months their arbitrary arrests of Palestinian students in the West Bank.”
Since November 15, PA security forces arrested 41 students, of whom 22 are still arbitrary jailed.
The statement pointed out that “most of the detained students in PA jails were nabbed without any legal basis; however they were arrested for their political affiliation, online status, or participation in some student events.”
The student’s arrest could be extended for long periods of time without any legal justification, the federation underlined, pointing to, in this matter, al-Najeh University student Mahmoud Assida who has been detained since November 15, 2014 pending investigation.
The Rome-based federation said that PA forces deliberately carry out their political arrest campaigns against the students during exams periods in order to deprive them from completing their school year.
The federation quoted family sources as saying the university student Bilal Hassania declared three days ago an open hunger strike protesting his renewed detention for 15 additional days. He was arrested on December 28, 2014.
Four university students are still held in PA jails for more than a month, while 7 others were nabbed 20 days ago without any legal basis, according to the statement.
The federation slammed PA security forces’ rejection to release some of those detained students despite obtaining court orders to release them.
The international federation stressed that these political arrests clearly violate the Universal Declaration of Human Rights and the international Covenant on Civil and Political Rights which criminalize persons’ arrests with no legal basis.
The federation pointed out that it has filed a complaint with the UN Special Rapporteurs on Arbitrary Detention about PA illegal political arrests, calling on PA ministers of Justice and Interior to release all political detainees.
In the same context, the popular committee of political detainees’ families declared intention to stage a sit-in on Thursday protesting against the PA continued political arrest policy.
The committee called in its press statement for mass participation in the sit-in that is scheduled to be organized in Ramallah afternoon Thursday.

The Palestinian Authority’s security forces in the West Bank arrested on Monday two citizens in al-Khalil city and issued detention renewal orders against another three for pending investigation.
In al-Khalil, the Palestinian Intelligence Services arrested two university students and renewed the detention of another two for two more days.
Meanwhile, the family of Zeid al-Jenaidi, who is detained at the PA Preventive Security Forces, said his heath is worsening because of the continuation of his hunger strike especially in the current extreme cold.
In a similar context, the PA national security released Samer al-Shawa after being held captive for days. He was taken to hospital on his release in the company of intelligence agents. “He could hardly walk”, local witnesses said.
The Islamic Bloc at al-Quds University declared an end to the peaceful sit-in, which lasted for 37 days, after signing a document of demands with the PA intelligence apparatus. It included ending the political detention at the university and the immediate release of students detained on political grounds.

In Ramallah, the PA intelligence forces arrested ex-detainee Samer al-Shawa a week after undergoing an eye surgery, knowing that he spent nearly seven years behind Israeli bars.
The PA security also continued to detain Idris Sudani, a university student from Beitunia. He was arrested about one month ago.
In Nablus, an ex-detainee called Ahmad Mohamed, 26, was detained by PA forces after raiding his parents' home. Ahmad has been arrested by the PA several time before.
Three other citizens were also taken prisoners by the PA security in Tarqumiyah town in al-Khalil.
In Jenin, the PA intelligence still refuses to release Jafar Murshid, 46, after arresting him with no reason two days ago. Murshid had spent four years in Israeli jails.

The International Federation for Human Rights and Development condemned PA forces’ brutal attack against the journalist and political activist Muath Omla in Nablus.
The Rome-based Federation pointed out in a statement issued Wednesday that two PA security personnel dressed in civilian clothes brutally attacked and severely beat up in late December the journalist Muath Omla due to his online criticism of the Qublan municipality performance.
"I was threatened twice after I expressed my views over the local Municipal Council’s performance in Qublan village", the statement quoted the journalist as saying.
The two security personnel were accompanied with the mayor’s son and one of his relatives, he added.
Muath suffered head injuries and several bruises all over his body and face.
While in hospital, he was also threatened by the mayor’s relatives to waive the complaint he made against the attackers.
The International Federation warned of the serious violations made against freedom of speech and public freedoms in the West Bank.
The Federation has documented since the beginning of December dozens of illegal arrests and summonses against journalists in the West Bank.
The statements called for maintaining the citizens’ right to express their opinions by all means guaranteed by law.
Representative of the Federation in the Middle East Joseph al-Sayegh said that the attack contradicts with the PA commitment to the international human rights law, and violates freedom of expression.

Baraa Yahya Ayash’s arrest is an act of revenge against his father, Zahhar wrote on his Facebook page, holding the PA Chairman Mahmoud Abbas fully responsible for the incident.

Senior Hamas leader Salah al-Bardawil Sunday slammed the Palestinian Authority (PA) apparatuses for taking Baraa Ayash, son of the Palestinian martyr Yahya Ayash, into custody.
Talking exclusively to the PIC on Sunday afternoon al-Bardawil said Baraa’s arrest makes part of the PA’s security coordination with the Israeli occupation.
He spoke out against the PA’s antagonistic impulses towards the Palestinian resistance icons and affiliates.
“Engineer Ayash shall forever remain an icon of heroism and resistance,” he vowed. “Ayash is far great to be affected by the leftovers of such parties, who act as if they were Palestinians.”
Baraa Ayash, 22, was arrested by the PA Preventive Security forces on Sunday, just a day before the 19th anniversary of his father's assassination by a booby-trapped cellular phone planted by the Israeli occupation forces.
Baraa has been summoned for interrogation by the intelligence apparatuses and the PA preventive forces for the fifth time, the Ayash family told the PIC.
“We thought that the PA apparatuses came to pay homage to the family on the anniversary of the Engineer’s assassination. But none of this happened and we’ve been taken aback by the interrogation summons,” they said.
Monday 5th January marks the 9th anniversary of the assassination of Yahya Ayash, Hamas armed wing's chief bomb-maker and leader of its West Bank branch. He earned the nickname the Engineer, in that capacity, and was assassinated by the Israeli occupation on 5 January 1996.

Baraa Ayash, 22, was arrested by the PA Preventive Security forces on Sunday, just a day before the 19th anniversary of his father's assassination by a booby-trapped cellular phone planted by the Israeli occupation forces.
Baraa has been summoned for interrogation by the intelligence apparatuses and the PA preventive forces for the fifth time, the Ayash family told the PIC.
“We thought that the PA apparatuses came to pay homage to the family on the anniversary of the Engineer’s assassination. But none of this happened and we’ve been taken aback by the interrogation summons,” they said.
Monday 5th January marks the 9th anniversary of the assassination of Yahya Ayash, Hamas armed wing's chief bomb-maker and leader of its West Bank branch. He earned the nickname the Engineer, in that capacity, and was assassinated by the Israeli occupation on 5 January 1996.
